COMMENTS MADE BY SENTENCING JUDGE:
"Well, I certainly take no pleasure in sentencing a 25-year-old man to life imprisonment; you can believe me when I say that. And I have thought about this a good deal..Congress has enacted these laws. They are very punitive, and have determined that punishment should be established in accordance with these Sentencing Guidelines..And I don't have anything, , to work with insofar as a downward departure..."
* Holmes' supplier was given 12 years in prison because he was charged with powder cocaine as opposed to crack cocaine:
* Holmes offense did not involve guns, links to gangs,cartels, or violence:
* The mandatory imposition of Holmes' life sentence was ruled unconstitutional by the Supreme Court in U.S. v. Booker, but because it was not made retroactive Holmes still sits in prison serving a punishment that amounts to a death sentence.
* Two of Holmes' co-defendants who were serving life without parole had their sentence commuted by President Obama (Jason Hernandez and Israel Torres)
